These Website Terms and Conditions (the "Terms") govern your use of www.apex-extrusion.com and any related pages, forms, chat, and text message program (together, the "Site"). The Site is operated by Advanced Plastic Extrusion LLC ("Apex," "we," "us," or "our"), 213 Sermon Road, Pollocksville, NC 28573.

1. Acceptance of These Terms

By using the Site, you agree to these Terms and to our Privacy Policy at www.apex-extrusion.com/privacypolicy. If you do not agree, please do not use the Site. If you use the Site on behalf of a company, you agree to these Terms on behalf of that company and confirm that you have authority to do so.

You may use the Site to learn about Apex and our products, contact us, and apply for jobs. You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose

  • Send spam, malware, or misleading information through our forms, chat, or email

  • Pretend to be someone else, or submit another person's contact information without permission

We may change, suspend, or discontinue any part of the Site at any time, and we may restrict access for anyone who violates these Terms.

3. Intellectual Property

The Site and its content, including text, product data, photos, graphics, logos, and design, are owned by Apex or its licensors and are protected by copyright, trademark, and other laws. APEX, APEXCAP™, SolidPro™, the Apex logo, and our other product names and logos are trademarks of Advanced Plastic Extrusion LLC. You may view and print pages of the Site for your own business use, such as evaluating our products. You may not copy, modify, distribute, sell, or create derivative works from Site content, or use our trademarks, without our prior written permission.

If you send us ideas, suggestions, or feedback, we may use them without any obligation to you. Please do not send us confidential information or drawings through the Site unless we have a confidentiality agreement in place.

4. Product Information, Quotes, and Orders

Product descriptions, specifications, property values, grade tables, gauges, widths, colors, and other technical information on the Site are provided for general information only. They are typical values, not guaranteed specifications, and they may change without notice. Actual results depend on the application, processing, and conditions of use. You are responsible for testing and determining whether a product is suitable for your use.

The Site is not an offer to sell. We do not share or sell mobile numbers or SMS opt-in data with third parties or affiliates for marketing purposes. See Section 4 of our Privacy Policy for details.

6. Third-Party Websites and Tools

The Site contains links to, and features from, third parties, such as Indeed, social media sharing buttons, and our live chat provider. We do not control and are not responsible for third-party websites, content, products, or practices. Your use of them is at your own risk and subject to their terms and privacy policies.

7. No Warranty

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, APEX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not promise that the Site will be error-free, uninterrupted, secure, or free of viruses. This section does not limit any written warranty for products in our quotations or terms of sale.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APEX AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT, EVEN IF WE WERE TOLD THESE DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED [ONE HUNDRED U.S. DOLLARS ($100)]. Liability for product purchases is governed by our quotations and terms of sale, not by this section.

9. Indemnity

You agree to defend, indemnify, and hold harmless Apex and its owners, employees, and agents from any claims, losses, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of anyone else's rights.

10. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site must be brought only in the state courts located in [Jones, CONFIRM] County, North Carolina, or the United States District Court for the Eastern District of North Carolina. You and Apex consent to the jurisdiction of those courts.

11. Changes to These Terms

12. General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Apex about the Site. They do not replace any quotation, purchase order, or terms of sale.
